Terms and Conditions of Bintani Presents Weyermann® Oktoberfest Competition

PROMOTER

The Promoter is Bintani Australia Pty Ltd (ABN 84 612 909 323) of 8 Grange Road, Moorabbin Airport VIC 3194 ("Promoter").
By entering this promotion, entrants agree to be bound by these Terms and Conditions.
Weyermann® have no affiliation with this promotion or competition.

PROMOTION PERIOD

The promotion commences at 12:01am AEST on 1 August 2026 and closes at 11:59pm AEST on 28 October 2026 ("Promotional Period").
Entries received outside the Promotional Period will not be accepted.

ELIGIBILITY

a) Entry is open to breweries located in Australia and New Zealand.
b) Entrants must be aged 18 years or over and be authorised representatives of the brewery they are entering on behalf of. The prize will be awarded to the brewery, with the nominated representative acting on its behalf.
c) Home brew shops, distilleries, consumers and individual hobby brewers are not eligible to enter.
d) Employees, contractors and immediate family members of the Promoter are deemed ineligible at the Promoter's discretion.
e) The Promoter reserves the right to verify the validity of entries and the eligibility of entrants and to disqualify any entrant who:

provides false, misleading or inaccurate information;
breaches these Terms and Conditions;
engages in fraudulent, misleading, offensive or inappropriate conduct;
is already receiving Weyermann® malt discount benefits outside this promotion
manipulates or attempts to manipulate the entry process; or
is otherwise reasonably determined by the Promoter to be ineligible.

HOW TO ENTER

To enter, eligible entrants must during the Promotional Period:
a) Publish a social media post featuring a beer brewed using Weyermann® malt;
b) Tag both @Bintani and @Weyermann in the post;
c) Publish the post on Instagram, Facebook or LinkedIn;
d) Ensure the post remains publicly visible and accessible until at least 23 October 2026.
Each eligible post will constitute one (1) entry.
Multiple entries are permitted provided each entry relates to a different beer.
Only one (1) entry is permitted per beer.
Where the same beer is posted across multiple social media platforms, only one (1) entry will be accepted.
The Promoter reserves the right to request reasonable evidence that separate entries relate to different beers.

PRIZE

There is one (1) prize available.
The prize consists of:
a) One (1) tonne of Weyermann® base malt; and
b) A Weyermann® merchandise bundle.
The total prize value is up to AUD $3,000 including GST.
The prize is not transferable, exchangeable or redeemable for cash.
If the prize or any element of the prize becomes unavailable due to circumstances beyond the Promoter's reasonable control, the Promoter reserves the right to substitute the prize with a prize of equal or greater value.

DRAW DETAILS

The draw will take place at 10:00am AEST on 30 October 2026.
The draw will be conducted by random selection from all valid entries received during the Promotional Period.
Each valid entry will have an equal and random chance of being selected.

Entrants do not need to be present at the draw to be eligible to win.

WINNER NOTIFICATION

The winner will be notified in writing via direct message through the social media platform used for entry within seven (7) days of the draw.
Where reasonably necessary, the Promoter may also attempt to contact the winner by email, telephone or any other contact method available to the Promoter.

WINNER PUBLICATION

As the prize value exceeds $1,000, the winner's name, brewery name and state/territory or country will be published on Bintani social media channels on or around 30 October 2026.
Winner information will remain publicly accessible for a minimum period of twenty-eight (28) days.

CLAIMING THE PRIZE

The winner must respond to the Promoter and provide any information reasonably required to facilitate delivery of the prize within two (2) months of the draw date.
The Promoter will make reasonable efforts to contact the winner using the contact details or communication channels available.
The prize will be transferred, supplied or otherwise made available to the winner within twenty-eight (28) days after all necessary delivery arrangements have been confirmed.
The winner will not incur any cost to accept the prize other than incidental or trivial costs.
If the prize is not claimed by 10:00am AEST on 30 December 2026, or if the winner is determined to be ineligible, the Promoter may conduct an unclaimed prize draw from the remaining eligible entries. The redraw will take place at 11:00am AEST on 07 January 2027 at the same location. The redraw winner will be notified within seven (7) days and published in the same manner as the original winner where required.

USE OF ENTRANT CONTENT

By entering the promotion, entrants grant the Promoter and Weyermann® a perpetual, non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, publish, communicate, display, repost and share submitted content, photographs, videos, brewery names, logos and related promotional material for marketing, promotional and commercial purposes without further compensation.
Entrants warrant that they own or have all necessary rights and permissions to submit the content and grant the licence contained in these Terms and Conditions, and that the content does not infringe the rights of any third party.
The Promoter will not claim ownership of entrant content.

PRIVACY

The Promoter may collect and use personal information for the purposes of:
a) administering the promotion;
b) verifying eligibility and entries;
c) contacting entrants and winners;
d) publishing winner information as required by law and these Terms and Conditions; and
e) promoting the Promoter's products, services and future promotions.
Entrants consent to the collection, use and disclosure of their personal information for the purposes set out above.
Personal information will be handled in accordance with the Promoter's Privacy Policy and applicable Australian and New Zealand privacy laws of the Privacy Act 1988 (Australia) and the Privacy Act 2020 (New Zealand).

LIABILITY

To the fullest extent permitted by law, the Promoter excludes all liability for any loss, damage, injury or claim arising directly or indirectly from participation in the promotion or acceptance and use of the prize, except where liability cannot lawfully be excluded.
The winner is responsible for obtaining independent taxation advice regarding any taxation consequences arising from acceptance of the prize.

SOCIAL MEDIA DISCLAIMER

This promotion is in no way sponsored, endorsed, administered by or associated with Instagram, Facebook or LinkedIn.
Entrants completely release Instagram, Facebook and LinkedIn from any liability associated with this promotion.
Entrants must ensure their social media post complies with all applicable advertising laws, platform policies and industry codes relating to the promotion of alcohol in the country in which the entrant operates.

GENERAL

a) The Promoter may verify entries and entrant eligibility at any time.
b) Incomplete, indecipherable, offensive, fraudulent or non-compliant entries may be deemed invalid.
c) The Promoter may cancel, suspend or modify the promotion where reasonably necessary due to circumstances beyond its reasonable control.
d) The Promoter will maintain records relating to the promotion, including accounting for entries, financial records, prize distribution and winner details, for a minimum period of three (3) years following completion of the promotion.
e) The promotion will be conducted in accordance with all applicable laws in Australia and New Zealand.
f) Any dispute concerning the conduct of the promotion will be determined by the Promoter acting reasonably and in accordance with applicable law.
g) Nothing in these Terms excludes, restricts or modifies any rights or remedies an entrant may have under the Consumer Guarantees Act 1993 (NZ), the Fair Trading Act 1986 (NZ), the Australian Consumer Law or any other applicable legislation which cannot lawfully be excluded.
